Aini Terms of Service

Effective date: 2 July 2026
Last updated: 31 August 2026

1. Who We Are; Acceptance of These Terms

These Terms of Service (the "Terms") are a binding agreement between you and Nishimta AB, a company incorporated under the laws of Sweden with its seat in Stockholm ("Nishimta", "we", "us"), governing your access to and use of Aini and the related websites, applications, browser extension, MacOS app, APIs, and services we provide (collectively, the "Service"). Our contact details appear in Section 19.

By creating an account, installing our software, or otherwise using the Service, you accept these Terms. If you use the Service on behalf of a company or other organization, you represent that you are authorized to bind that organization, and "you" refers to it. If you do not agree to these Terms, do not use the Service.

Our Aini Privacy Policy separately describes how we handle personal data.

2. The Service

Aini is an AI-powered assistant and workspace. It lets you chat with an AI assistant, pin and capture content from web pages you choose using the Aini browser extension, set up connections to third-party tools you use, and explore and visualize your information. Your account, conversations, and pinned content are available across the surfaces you use — web app, MacOS app, and browser extension — each of which may offer different features. The Service is under active development, and parts of it are offered as early access, as described in Section 11.

The Service is currently provided free of charge. We may introduce paid plans in the future; if we do, pricing and payment terms — including any right of withdrawal that mandatory consumer law grants — will be presented to you before any charge applies.

3. Accounts and Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to use the Service. To access most features you must register an account and provide accurate, current information, which you agree to keep up to date.

Sign-in is handled through our authentication provider. You are responsible for safeguarding your sign-in method and credentials and for all activity that occurs under your account. Notify us promptly at legal@nishimta.com if you suspect unauthorized use of your account. We may suspend or refuse any account we reasonably believe is compromised, fraudulent, or used in violation of these Terms.

4. Your Content; Ownership and License

"Customer Content" means everything you submit to, capture with, or connect to the Service: chat prompts and messages, files (currently images) you upload, page content and screenshots captured through content pinning, the rooms and stakeholder records you create, and data retrieved from third-party tools you connect.

You own your Customer Content. These Terms do not transfer any ownership of Customer Content to Nishimta. You grant Nishimta a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, and display Customer Content solely as necessary to operate, provide, secure, maintain, and support the Service — including sending it to the AI provider described in Section 5 and the other processors listed in our Privacy Policy, and, at your direction, to the third-party services you connect under Section 6 — and to comply with law. This license ends when the Customer Content is deleted from the Service (whether by you or on your request), except for copies retained in routine backup cycles or as required by law.

You are responsible for your Customer Content. You represent that you have all rights necessary to submit it to the Service and to grant the license above, and that doing so does not violate law, third-party rights, or agreements that bind you (including your employer's policies).

5. AI Features and Outputs

The assistant's responses, summaries, visualizations, and other generated content ("Outputs") are produced by artificial-intelligence models. To generate them, we transmit your prompts and relevant context — which may include pinned page content, screenshots, uploaded images, and, where available, data from connected tools — to the third-party AI provider identified in our Privacy Policy, acting as our processor (or sub-processor, where we process on behalf of your organization) under contractual confidentiality and data-protection obligations.

You should understand and accept the nature of AI-generated content:

  • Outputs may be inaccurate, incomplete, out of date, or misleading. Models can produce statements that sound confident and authoritative but are wrong. You must review and independently verify Outputs before relying on them or sharing them.
  • Outputs are not professional advice. Nothing the assistant produces constitutes legal, medical, financial, tax, or other regulated professional advice, and no professional-client relationship is created by your use of the Service. Consult a qualified professional for decisions in those areas.
  • Outputs are not unique. Because models can produce similar output for similar prompts, other users may receive the same or similar Outputs.

As between you and Nishimta, and to the extent permitted by law, we assign to you our rights, if any, in Outputs generated for you, subject to the rights of third parties whose material may be reflected in them. You are solely responsible for how you use Outputs and for decisions and actions you take based on them.

6. Third-Party Connections

The Service lets you set up connections to third-party tools and data sources in your account. When you set up a connection, we store the configuration details you provide and use them only to operate that connection. Where a connection accesses data from a third-party tool, you authorize Nishimta to access, retrieve, and process that data on your behalf. You may remove a connection at any time in the Service.

You represent that you have the right to connect each tool and to allow that access — including compliance with that tool's terms of service and any rights or permissions required under your agreements with the third party, your employer, or the organization that owns the account. Third-party services are governed by their own terms and privacy policies, and your use of them is at your own risk. Nishimta does not control third-party services and is not responsible for their content, availability, accuracy, security, or practices, or for changes they make that affect the Service. We may add, change, or discontinue support for any third-party connection at any time.

7. Browser extension and MacOS app

Browser extension. The extension's content-pinning feature captures content only from pages and elements you actively choose to pin. When you pin content, the extension may capture visible page text and structure and a bounded screenshot of the pinned area, and send that capture to the Service for processing; page code, hidden content, and form-draft text are filtered before upload. The extension does not capture page content in the background. To re-display your pins while you are signed in, it sends the web address of pages you visit to the Service to look up pins you saved there, as described in our Privacy Policy. Do not pin content from pages you are not permitted to access or share — you are responsible for ensuring your pins comply with applicable law, confidentiality obligations, third-party rights, and any terms that govern the page.

MacOS app. The MacOS app may check for and install updates automatically. Updates will be cryptographically signed, and the app will verify each update's signature before installing it. Automatic updates keep the app secure and current; if you do not want automatic updates, you can stop using and uninstall the app. If you are a consumer and a modification negatively affects your access to or use of the app more than insignificantly, you have the notice and termination rights that mandatory consumer law provides.

Subject to these Terms, Nishimta grants you a limited, non-exclusive, non-transferable, revocable license to install and use the browser extension and MacOS app, in object code form, on devices you own or control, solely to access the Service.

8. Acceptable Use

You agree not to, and not to permit anyone else to:

  • use the Service in violation of applicable law or these Terms, or for any unlawful, harmful, or fraudulent purpose;
  • pin, upload, or connect content or accounts you do not have the right to access, use, or share, or otherwise infringe or misappropriate the rights of others;
  • probe, scan, or test the vulnerability of the Service, bypass its security, authentication, or usage limits, or interfere with its operation (including by imposing an unreasonable load);
  • reverse engineer, decompile, or disassemble the Service or attempt to extract its source code, except to the extent such a restriction is prohibited by applicable law;
  • access the Service to build a competing product, systematically extract its Outputs or functionality, or scrape or harvest data from the Service other than your own Customer Content;
  • resell, sublicense, or provide the Service to third parties as a standalone offering or service bureau without our written agreement;
  • use the Service to generate or distribute malware, spam, or deceptive content, or misrepresent Outputs as human-generated where that would be deceptive or where disclosure is legally required; or
  • use Outputs to train competing AI models where prohibited by the terms of our upstream model providers.

We may investigate suspected violations and may remove content, suspend accounts, or take other reasonable measures to protect the Service, our users, or third parties.

9. Intellectual Property

Nishimta and its licensors own the Service, including its software, models, applications, extension, interfaces, designs, documentation, and branding, together with all associated intellectual-property rights. Except for the limited rights expressly granted in these Terms, no rights in the Service are granted to you, whether by implication, estoppel, or otherwise. You may not use the Aini or Nishimta names, logos, or trademarks without our prior written consent.

10. Feedback

If you send us suggestions, ideas, or other feedback about the Service, you grant Nishimta a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without restriction or obligation to you. Feedback does not include your Customer Content. Do not send us feedback that is confidential to you or anyone else.

11. Availability; Changes to the Service; Early Access

We work to keep the Service available and performant, but it is provided without any uptime commitment and may be unavailable due to maintenance (with or without notice), updates, or events outside our control.

The Service evolves continuously, and we may add, modify, limit, or remove features at any time. Features identified or reasonably understood as early access, beta, preview, or experimental are provided as-is for evaluation, may be less stable than the rest of the Service, may change or be withdrawn without notice or liability, may be subject to additional terms, and should not be relied on for production or business-critical use. If a change materially reduces core functionality you have paid for (where you use the Service under a paid plan), or if we discontinue the Service entirely, we will give you reasonable advance notice where practicable, and you may request a copy of your Customer Content by contacting us at legal@nishimta.com.

12. Term and Termination

These Terms apply from your first use of the Service and continue until terminated. You may stop using the Service at any time. To delete your account, contact us at legal@nishimta.com and we will delete it within a reasonable period.

We may suspend or terminate your access, with notice where reasonably practicable, if you materially breach these Terms, if required by law, if your use poses a security or legal risk to us, the Service, or others, or if we discontinue the Service. Upon termination, your right to use the Service ends and we may delete your Customer Content after a reasonable period, subject to our Privacy Policy and legal retention obligations — request a copy of anything you need before your account closes. Section 4 (to the extent its license continues under its own terms after deletion) and Sections 5, 9, 10, and 13 through 18 survive termination.

13. Disclaimers of Warranty

To the fullest extent permitted by applicable law, the Service and all Outputs are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Outputs will be accurate, complete, or fit for your purposes. Nothing in this section limits warranties or remedies that mandatory law grants to consumers.

14. Limitation of Liability

To the fullest extent permitted by applicable law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, even if advised of the possibility; and (b) Nishimta's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (i) the fees, if any, you paid to Nishimta for the Service in the twelve (12) months before the event giving rise to liability and (ii) SEK 500.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be limited under applicable law. If you are a consumer, nothing in these Terms affects your mandatory statutory rights.

15. Indemnity

If you use the Service on behalf of a business or other organization, that organization will defend and indemnify Nishimta against third-party claims, and resulting damages and reasonable costs, arising from its Customer Content, its connections to third-party tools, or its use of the Service in breach of these Terms or applicable law. This section does not apply to consumers.

16. Governing Law and Disputes

These Terms are governed by the substantive laws of Sweden, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Service shall be resolved by the Swedish courts, with the Stockholm District Court (Stockholms tingsrätt) as the court of first instance.

If you are a consumer, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country in which you habitually reside, or of your right to bring proceedings in the courts of that country; where EU law so provides, proceedings against you may be brought only in those courts. Consumers residing in Sweden may also refer disputes to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, arn.se.

17. Changes to These Terms

We may update these Terms from time to time, for example to reflect new features or legal requirements. For material changes we will give you reasonable advance notice — through the Service or by email — before the updated Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms; if you do not agree, stop using the Service before that date and, if you wish, delete your account as described in Section 12. The current version is always available in the Service, and the "Last updated" date above reflects it.

18. General

These Terms, together with any additional terms we present for specific features, are the entire agreement between you and Nishimta regarding the Service and supersede prior agreements on that subject; our Privacy Policy separately describes how we process personal data. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control.
